Xoom and Goldilocks Promotion Terms and Conditions

The following terms and conditions constitute the binding legal agreement (the “Promotion Agreement”) between Xoom Corporation (“Xoom”), MC Business Development Corp. (“Goldilocks”), and You.

Xoom and Goldilocks reserve the right to make changes to these Terms and Conditions and the Promotion Agreement at any time. The current Promotion Agreement will be posted on the Xoom website during the promotion without prior notice. The $25 Gift Check Promotion is subject to the terms of this Promotion Agreement.

Participation in the Promotion

TERMS and CONDITIONS

  1. As a participant in the Promotion, you agree that Xoom and Goldilocks may share your personal information with one another, as necessary to conduct the Promotion, and that Xoom and Goldilocks may send you communications regarding the Promotion.

  2. PROMOTION OFFER DETAILS

    Send your first money transfer with Xoom and get a $25 Goldilocks gift check.

    $25 gift check offer valid for new customers who successfully send a money transfer between February 15, 2011 to May 15, 2012. One offer per customer. The gift check is good for one time use only and is valid at all Goldilocks USA branches. The Goldilocks gift check expires on May 31, 2013. Any tampering, changes or damages to the Goldilocks gift check will render it void. Xoom or Goldilocks will not replace any lost or damaged gift checks. Offer subject to change without notice. Restrictions apply.

  3. HOW TO REDEEM THE “OFFER”
    1. Go to xoom.com/goldilocks.
    2. Follow the link directly to the Xoom.com website from Goldilocks’ referral (e.g., clicking on a link at another website) and complete the initial registration and initial money transfer. You must complete the transfer without (i) clearing the cookies on your computer, (ii) without closing the Xoom.com website and later returning to the Xoom.com website, and (iii) without clicking on any other Xoom.com links.
    3. Use the xoom.com website to transfer money for the first time and in a manner that is compliant with the Xoom User Agreement.
    4. Within 24 hours of the transaction completion, you will receive an email from Xoom confirming your eligibility for the gift check. The gift check will be mailed within 10 business days after your eligibility is confirmed.
    5. Offer available only to first-time customers of Xoom who send money to the Philippines between February 15 -May 15, 2012
    6. The $25 Goldilocks gift check will be voided for any Xoom transaction that is later canceled (either by User or by Xoom), or determined (at Xoom’s sole discretion) to be fraudulent.
    7. One offer per new customer.
    8. The $25 gift check is valid for one time use only at any Goldilocks USA branch.
    9. The $25 gift check expires on May 31, 2013.
    10. Any tampering with, change or damage to the Goldilocks gift check will render it void. Xoom or Goldilocks will not replace any lost or damaged gift check.
    11. Subsequent money transfers after the first successful Xoom money transfer do not qualify for the offer.
    12. Xoom and Goldilocks reserve the right to void any offer redemption that appears to be fraudulent, and to void any gift check that results from a fraudulent Xoom transaction.

  4. LIMITATION OF LIABILITY/WARRANTIES

    Xoom expressly disclaims any and all liability associated with or arising from your use of the Goldilocks service. Resolution of all questions or disputes regarding eligibility for the Promotion, or your compliance with the terms and conditions of this Promotion Agreement is the responsibility of Xoom.

    IN NO EVENT SHALL XOOM BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR PARTICIPATION IN THIS PROMOTION, INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE AND/OR CONSEQUENTIAL DAMAGES, EVEN IF XOOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE XOOM USER AGREEMENT, INCLUDING THE SECTIONS ON LIMITATION OF LIABILITY (SECTION 11) AND DISPUTE RESOLUTION/GOVERNING LAW (SECTION 12) ARE EXPRESSLY INCORPORATED HEREIN BY REFERENCE.

    ALL WARRANTIES, EXPRESS AND IMPLIED, ARE DISCLAIMED (INCLUDING, WITHOUT LIMITATION, THE DISCLAIMER OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND/OR FITNESS FOR A PARTICULAR PURPOSE). XOOM MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO ANY RESULTS OBTAINABLE THROUGH THE PROMOTION.

  5. EXPIRATION AND DELIVERY OF THE PROMOTION

    The Promotion expires May 15, 2012. Transactions submitted between February 15, 2012 and May 15, 2012 will be eligible for the promotional offer. Offer is only valid for new customers. One-time use.

    Businesses are not eligible for the Promotion, and the offer may not be used for any commercial purpose, as determined by Xoom at its sole and absolute discretion.

  6. OTHER TERMS AND CONDITIONS
    1. Xoom reserves the right to terminate the Promotion at any time without notice.
    2. Xoom reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary any and/or all of the terms of the Promotion Agreement or to replace, wholly or in part, the Promotion with another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
    3. Users may not participate in the Promotion where doing so would be prohibited by any applicable law, statute or regulations. All information collected from a user as part of the Series Promotion shall be subject to the Xoom’s Privacy Policy.
    4. The Promotion is subject to force majeure events.
    5. The Promotion has no cash value and may not be combined with any other offer. Xoom is the final authority on the Promotion and the interpretation of this Promotion Agreement.
